01
Acceptance of these Terms
By accessing or using porchpixelstudio.com, you agree to these Terms of Service and to the Privacy Policy. If you do not agree, do not use the website or submit information through it.
“PorchPixel Studio,” “we,” “us,” and “our” refer to the studio operating this website. “You” refers to the person or organization accessing the website or submitting an inquiry.
02
Purpose of the website
This website provides general information about PorchPixel Studio, our areas of experience, website services, packages, working approach, and ways to contact us.
The website is not a binding offer to perform services. Viewing the website, requesting a free website review, or exchanging preliminary messages does not by itself create a client, partnership, employment, fiduciary, or agency relationship.
03
Eligibility and lawful use
You may use the website only for lawful purposes and in a way that does not infringe the rights of PorchPixel Studio or another person.
If you submit information on behalf of a company or another person, you represent that you have authority to do so. This website is intended for adults and business decision-makers, not children.
04
Website reviews and inquiries
A free website review or initial inquiry is preliminary. Any observations are based on the information and publicly accessible website version available at the time of review.
We may request additional information, decline an inquiry, recommend a different scope, or decide that a project is not a suitable fit. Submission of a form does not guarantee a response time, project availability, a particular recommendation, acceptance of work, or any business result.
Preliminary comments are general professional observations, not legal, financial, accessibility-certification, cybersecurity-audit, or guaranteed SEO advice.
05
Separate agreements for paid projects
Paid work begins only after the parties confirm the project in writing. A proposal, statement of work, invoice, email approval, contract, or combination of these may define:
- Deliverables and exclusions
- Project phases and responsibilities
- Price, deposits, milestones, and payment dates
- Estimated timing and dependencies
- Revision limits and change requests
- Hosting, maintenance, and third-party costs
- Ownership, licensing, and portfolio permissions
- Cancellation, suspension, and termination terms
If a separate written project agreement conflicts with these website Terms, the separate project agreement controls for that project.
06
Packages, pricing, timelines, and availability
Prices and packages displayed on the website are starting points or general descriptions unless explicitly stated otherwise in a written project agreement. They may change, and they may not include every requirement, third-party charge, tax, content need, integration, revision, maintenance task, or custom feature.
The final scope, price, payment schedule, timeline, and availability are confirmed in writing after the project requirements are understood. Website copy describing a package does not override a later proposal or agreement.
Any timeline discussed before the required information, content, approvals, access, and payment are received is an estimate rather than a guarantee.
07
Client information and materials
For any project, you are responsible for providing accurate information, timely feedback, required access, and materials you are legally allowed to use. This can include text, logos, trademarks, images, videos, reviews, business claims, policies, pricing, credentials, and third-party account access.
You are responsible for reviewing and approving the factual accuracy and legal suitability of your business content. PorchPixel Studio does not independently verify every business claim, licence, testimonial, service description, image permission, or regulatory obligation unless a written agreement expressly says otherwise.
08
Intellectual property on this website
Unless otherwise stated, the website’s original text, design, layout, graphics, code, brand elements, and other studio-created materials are owned by or licensed to PorchPixel Studio and are protected by applicable intellectual-property laws.
You may view and print reasonable portions for personal or internal business evaluation. You may not copy, reproduce, republish, sell, scrape, distribute, modify, frame, reverse engineer, or create derivative works from the website or its original materials without prior written permission, except where applicable law expressly permits it.
Ownership and permitted use of deliverables created for a paid client project are governed by that project’s written agreement, not solely by these website Terms.
09
Information and materials you submit
You retain ownership of information and materials you submit. You grant PorchPixel Studio a limited, non-exclusive permission to receive, store, review, reproduce, and use those materials only as reasonably necessary to evaluate your inquiry, communicate with you, prepare a proposal, provide agreed services, protect the website, or comply with law.
Do not submit material that is unlawful, infringing, malicious, misleading, or that you are not authorized to share. Do not send passwords, private keys, payment-card data, government identification numbers, health information, or other highly sensitive information through the general contact form.
No general website form or preliminary email should be treated as a confidential disclosure under a non-disclosure agreement unless PorchPixel Studio has separately agreed in writing to confidentiality terms.
10
Portfolio, project, and third-party references
The website may display project examples, screenshots, business names, domain names, trademarks, or links to third-party websites. Third-party names and marks belong to their respective owners.
A project reference should be read according to the description provided. It does not automatically mean the referenced business is a current client, endorses PorchPixel Studio, or engaged us for every part of the website, marketing, content, or SEO shown.
Live third-party websites can change after our work or contribution. We do not control later edits, performance, availability, security, claims, or content on those websites.
11
Prohibited conduct
You must not:
- Use the website for unlawful, fraudulent, abusive, or deceptive activity
- Submit spam, malicious code, automated junk inquiries, or false identity information
- Attempt to bypass rate limits, security controls, access restrictions, or form validation
- Probe, scan, disrupt, overload, or interfere with the website, server, or connected services
- Scrape or harvest contact information or content at an unreasonable scale
- Impersonate PorchPixel Studio or falsely suggest affiliation or endorsement
- Infringe intellectual-property, privacy, confidentiality, or other rights
We may block access, reject submissions, preserve relevant evidence, or report unlawful conduct where reasonably necessary.
12
Third-party services and links
The website may rely on or link to third-party hosting, email, font, analytics, security, portfolio, social, payment, scheduling, or other services. Those services are governed by their own terms and privacy practices.
PorchPixel Studio does not control and is not responsible for third-party content, availability, security, pricing, policies, or actions. A link does not necessarily mean we endorse every statement, product, or service on the linked website.
13
Website disclaimers
The website and its general content are provided on an “as available” and “as is” basis. While we aim to keep information accurate and useful, we do not guarantee that every page will always be complete, current, uninterrupted, error-free, secure, or suitable for a particular purpose.
Website design, SEO foundations, content structure, usability improvements, and other services can support a business, but results depend on many factors outside our control. We do not guarantee rankings, traffic, leads, revenue, conversions, sales, platform approval, uninterrupted hosting, or a particular commercial outcome.
Nothing on this website is legal, tax, financial, employment, regulatory, insurance, or other licensed professional advice.
14
Limitation of liability
To the maximum extent permitted by applicable law, PorchPixel Studio will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss arising from use of, reliance on, or inability to use this website. This includes loss of profits, revenue, business opportunity, data, goodwill, or anticipated savings.
Our liability for paid services is governed by the applicable project agreement. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability arising from fraud or other non-excludable obligations.
15
Governing law, jurisdiction, and disputes
These website Terms and any dispute arising from or relating to them are governed by the laws of the State of Delaware and applicable federal laws of the United States, without regard to conflict-of-law rules that would apply another jurisdiction’s laws.
Subject to any mandatory legal rights or jurisdiction that cannot lawfully be excluded, you and PorchPixel Studio agree that any legal proceeding concerning these Terms or use of the website will be brought exclusively in a state or federal court located in Delaware, United States, and each party consents to the personal jurisdiction and venue of those courts.
Before starting formal proceedings, the parties should first attempt in good faith to resolve the issue through written communication. This section does not prevent either party from seeking urgent injunctive or protective relief where reasonably necessary.
A separate client proposal, contract, or statement of work may specify a different governing law, venue, arbitration process, or dispute procedure. Where it does, that written project agreement controls for the relevant paid project.
16
General terms
If any provision of these Terms is found unenforceable, the remaining provisions will continue to apply. A failure to enforce a provision immediately does not waive the right to enforce it later.
These Terms, together with the Privacy Policy, form the agreement governing general use of this website. They do not replace a separate agreement governing a paid project.
17
Changes to these Terms
We may update these Terms when the website, services, business practices, or legal requirements change. The updated version will be published on this page with a revised effective date.
Your continued use of the website after an update means the revised Terms apply from the stated effective date. Changes to an existing paid project will be handled under the relevant project agreement rather than by silently changing that agreement through this page.
